1. Introduction
Welcome to SEDA ROSE Jewellers.
These Terms & Conditions govern the use of our website, jewellery enquiries, quotations, purchases, personalised sourcing, bespoke design services and any additional programs expressly made available by SEDA ROSE Jewellers.
Throughout these Terms, “SEDA ROSE”, “we”, “our” and “us” refer to the business operator identified above.
By placing an order or engaging a paid service, customers agree to the terms disclosed and accepted in connection with that transaction.
Additional written terms may apply to particular purchases, services or promotional programs. Where applicable, these will be provided before the customer becomes bound by them.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory remedy or other right that cannot lawfully be excluded.
2. Our Business and Services
SEDA ROSE Jewellers is an independent fine jewellery retailer offering personalised sourcing, jewellery selection assistance and bespoke design coordination.
We may obtain jewellery, loose diamonds, gemstones, settings and other products from Australian or international manufacturers, wholesalers, independent suppliers and third-party retailers.
Our services may include:
- Locating jewellery that meets a customer's preferences and budget.
- Assisting with gemstone and diamond selection.
- Coordinating bespoke jewellery design and manufacturing.
- Obtaining quotations from suitable suppliers.
- Arranging procurement, payment and delivery.
The availability, scope and extent of these services depend on the individual enquiry.
SEDA ROSE retains reasonable commercial discretion regarding the enquiries, commissions and suppliers it accepts, subject to applicable law.
Unless expressly stated otherwise, SEDA ROSE is not affiliated with, sponsored by or an authorised dealer of third-party jewellery brands.
Where SEDA ROSE sells jewellery directly to a customer, we act as the retailer and remain responsible for our applicable legal obligations.
3. Product Descriptions and Representations
We aim to provide accurate information about jewellery offered through our website and individual quotations.
Product photographs are illustrative. Minor visual differences may arise from lighting, photography, screen settings, natural gemstone characteristics and manufacturing tolerances.
Material differences affecting a product's identity, value, quality or agreed specifications will not be treated as merely cosmetic variations.
Relevant product information may include:
- Natural or laboratory-grown gemstone origin.
- Gemstone characteristics, treatments and grading information.
- Precious-metal type and purity.
- Jewellery measurements and specifications.
- Product condition, including whether an item is new or pre-owned.
- Included certification and documentation.
We will provide accurate disclosures as required by applicable law.
No independent grading certificate, particular gemstone grade, investment value or resale value is guaranteed unless expressly included in the accepted quotation or otherwise required by law.
4. Enquiries and Consultations
Submitting an enquiry, design request or inspiration photograph does not create an obligation to purchase.
SEDA ROSE may provide preliminary discussions, sourcing research or initial guidance without a separate charge, at our discretion.
Complimentary consultation services are limited to a reasonable scope determined according to the nature and complexity of the enquiry.
We may decline further unpaid consultation, sourcing research or design revisions where the work requested becomes extensive.
If a separately charged service is proposed, its scope and price will be disclosed and agreed before chargeable work begins.
No retrospective consultation fee will be imposed for work previously offered without an agreed fee.
Ordinary sourcing, consultation, administration and design coordination costs may be incorporated into the final retail price of jewellery.
5. Quotations and Pricing
Unless expressly stated otherwise, prices and quotations are expressed in Australian dollars (AUD).
A quotation will identify the relevant jewellery specifications, final retail price, applicable charges, estimated delivery arrangements and any material conditions of the proposed purchase.
Our retail prices may incorporate supplier costs, consultation, sourcing, design coordination, administration, delivery arrangements and our commercial profit margin.
We are not obliged to disclose confidential supplier pricing, internal cost calculations or profit margins except where required by law.
Quotations are generally valid for 48 hours, unless a different validity period is stated in writing.
All quotations remain subject to the availability and conditions clearly disclosed before acceptance. Supplier availability must be confirmed before an order is accepted.
An expired quotation may be revised or withdrawn before a binding order is formed.
Once a binding order has been accepted, any price changes are subject to the agreed contract and applicable law.
6. Written Order Approval
Before SEDA ROSE procures, reserves at its own expense or commissions jewellery, the customer must provide written approval of the relevant order details.
Written approval may be provided by email or another written communication accepted by SEDA ROSE.
Approval must cover the applicable:
- Jewellery description and specifications.
- Gemstone and precious-metal details.
- Final retail price and charges.
- Estimated delivery timeframe.
- Customisation or special-order requirements.
- Included certificates and supporting documentation.
- Material purchase conditions.
The customer is responsible for checking the details presented for approval and notifying us of errors before confirmation.
SEDA ROSE will retain appropriate records of quotations, written approvals, payments and relevant order communications.
7. Payment and Order Acceptance
Unless otherwise expressly agreed, full cleared payment is required before SEDA ROSE commits funds to purchasing, reserving or commissioning jewellery.
We may conduct preliminary sourcing research and obtain supplier quotations before payment without committing to procurement.
Submitting an order request or making a payment does not necessarily mean that SEDA ROSE has accepted the order.
An order becomes binding when accepted and confirmed by SEDA ROSE, subject to applicable contract and consumer law.
Payments must be made using payment methods authorised by SEDA ROSE.
Applicable taxes, shipping charges and any lawful payment surcharges will be disclosed before payment.
We may carry out reasonable payment, identity and fraud-prevention checks where permitted by law.
8. Supplier Availability and Substitutions
Jewellery, diamonds and gemstones may be subject to changing supplier availability.
SEDA ROSE does not guarantee that an item discussed during an enquiry remains available until its availability has been confirmed and the order secured.
If an agreed item becomes unavailable, we may offer a suitable alternative.
Any material differences in gemstone characteristics, jewellery specifications, price or other relevant features will be disclosed.
No material substitution or additional charge will be made without the customer's approval.
If SEDA ROSE cannot fulfil an accepted order and the customer does not agree to an alternative, the customer will receive the refund or other remedy required by applicable law.
9. Bespoke and Specially Sourced Jewellery
Bespoke, customised and specially sourced jewellery may be ordered or manufactured specifically for an individual customer.
Customers must carefully review and approve all relevant specifications before confirming their order.
Once an order has been accepted, subsequent changes are not guaranteed.
SEDA ROSE may consider requested changes where commercially and technically feasible.
Any proposed additional charges or revised specifications must be approved before proceeding.
SEDA ROSE does not offer a general voluntary right to cancel a confirmed bespoke or specially sourced order because of a change of mind.
However, cancellation conditions cannot override applicable consumer guarantees, statutory remedies or other mandatory legal rights.
Any cancellation charges or retention of payments must be lawful, properly disclosed and enforceable.
10. Customer-Supplied Designs and Inspiration
Customers may submit photographs, drawings, sketches or other reference materials to communicate their preferences.
Such materials may be used as inspiration for sourcing or design discussions.
SEDA ROSE does not guarantee exact reproduction of a third party's jewellery design.
Customers must have any permissions legally required for materials they request us to reproduce.
SEDA ROSE may decline a design request where it reasonably considers that the proposed work may infringe intellectual property rights or create other legal or commercial risks.
Customer-provided materials will be handled in accordance with applicable law and our Privacy Policy.
11. Diamond Grading and Product Documentation
Independent grading reports, gemstone certificates, authenticity documentation and other supporting materials are provided only where included in the relevant purchase or required by law.
Documentation may be issued by an independent laboratory, manufacturer, supplier or other relevant organisation, as accurately described.
SEDA ROSE does not represent every diamond or jewellery item as GIA-certified, IGI-certified or independently graded.
Any replacement documentation service is subject to availability.
Where a separate fee may lawfully apply, the customer will be informed and asked to approve it beforehand.
No documentation charge will be imposed where doing so would conflict with a customer's statutory rights.
12. Quality Inspection and Supplier Fulfilment
Depending on the product and fulfilment arrangements, jewellery may be:
- Received and inspected by SEDA ROSE before dispatch.
- Inspected or quality-checked by the relevant manufacturer or supplier.
- Dispatched directly to the customer by an approved supplier or fulfilment provider.
SEDA ROSE will not claim to have personally inspected an item unless that inspection has actually occurred.
Supplier involvement or direct dispatch does not remove any legal responsibility SEDA ROSE has as the retailer.
13. Delivery and Shipping
SEDA ROSE may arrange delivery within Australia and to selected international destinations, subject to product availability, shipping restrictions and applicable law.
Shipping methods, estimated delivery periods and applicable charges will be communicated before purchase confirmation.
Delivery estimates are not guaranteed deadlines unless expressly agreed.
Delivery may be affected by manufacturing schedules, supplier availability, customs processing, carrier disruptions or other circumstances.
Where reasonably available and appropriate, SEDA ROSE may use tracked and insured shipping services.
For security, we may require delivery to a verified recipient, including signature and identification checks where supported by the carrier and permitted by law.
Authority-to-leave delivery may be unavailable for certain orders.
Customers must provide accurate delivery information and cooperate with reasonable lawful delivery-verification requirements disclosed before purchase.
Where delays, loss, damage or failed delivery occur, the parties' rights and obligations will be determined by the accepted order and applicable law.
14. International Orders
International orders may be subject to customs clearance, import restrictions, duties, taxes and other destination-country requirements.
Where lawful, import duties, local taxes and customs clearance charges not included in the agreed retail price are the customer's responsibility, provided these arrangements have been appropriately disclosed.
SEDA ROSE remains responsible for any taxes or charges that applicable law requires us to collect or pay.
We may decline an international order before acceptance where shipping, customs, payment, fraud-prevention or legal requirements cannot reasonably be satisfied.
Customers remain entitled to any mandatory consumer protections that apply to their purchase.
15. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Where applicable, customers may be entitled to a repair, replacement, refund, cancellation or compensation when goods or services fail to meet statutory requirements.
The appropriate remedy depends on the circumstances and the applicable law, including whether a failure is major or minor.
SEDA ROSE will provide remedies where legally required.
Customers are not required to pursue a manufacturer or supplier instead of SEDA ROSE where SEDA ROSE is legally responsible as the retailer.
Nothing in these Terms limits or excludes any statutory consumer guarantee or other right that cannot lawfully be excluded.
16. Returns, Refunds and Exchanges
SEDA ROSE does not generally provide voluntary refunds, exchanges or returns for change of mind, incorrect personal preference or a decision not to proceed with a purchase.
This policy applies to ready-made, bespoke and specially sourced jewellery, subject to applicable law and any express written agreement.
Customers who believe their jewellery is faulty, incorrectly described, damaged or otherwise fails to meet applicable consumer guarantees should contact SEDA ROSE.
We may reasonably request order details, photographs, proof of purchase or other information relevant to assessing the concern.
Where legally required, we will provide the appropriate remedy.
A statutory refund will not be replaced with store credit against the customer's wishes where the customer is legally entitled to a monetary refund.
No restocking, administrative, certification or other fee will be imposed where doing so would unlawfully reduce a customer's statutory remedy.
17. Warranties, Repairs and Jewellery Care
SEDA ROSE does not provide an additional voluntary jewellery warranty unless expressly agreed in writing.
All applicable statutory consumer guarantees remain in effect regardless of whether an additional warranty is offered.
Normal wear, accidental damage, misuse, inappropriate care, customer-requested alterations and unrelated third-party damage are not automatically defects for which SEDA ROSE is responsible.
A third-party repair or alteration does not automatically extinguish statutory rights concerning unrelated faults.
Resizing, repairs, maintenance and replacement services may be available by separate agreement.
SEDA ROSE is not obliged to provide such services without charge unless required by law or expressly agreed.
18. Customer Accounts and Transaction Security
Customers must provide accurate information when creating an account, making an enquiry or placing an order.
Customers are responsible for maintaining the confidentiality of their account credentials and notifying us of suspected unauthorised access.
SEDA ROSE may conduct reasonable verification before processing high-value orders, account changes or sensitive requests.
Where legally permitted, we may temporarily restrict suspicious account activity or transactions while conducting proportionate fraud or security checks.
We may refuse transactions or suspend services for genuine fraud, material misuse or other lawful grounds.
Such measures will not result in unlawful forfeiture of valid customer funds or statutory rights.
19. Website Errors and Technical Availability
We aim to maintain accurate product information, pricing and website functionality.
Occasional typographical, technical, pricing or availability errors may occur.
SEDA ROSE may correct genuine errors and, where legally permitted, decline or cancel an order affected by an error.
A website disclaimer does not automatically entitle us to cancel a binding contract or increase an agreed price.
If an order is lawfully cancelled after payment, the appropriate refund or other remedy will be provided.
We do not guarantee uninterrupted website availability, but remain responsible for obligations imposed by applicable law.
20. Bespoke Program — Prepaid Jewellery Store Credit
Current Status: Not Yet Open for Customer Contributions
The SEDA ROSE Bespoke Program is a proposed flexible prepaid jewellery store-credit arrangement intended to help customers contribute towards future jewellery purchases.
The proposed arrangement includes voluntary contributions towards a customer-selected spending target, with the jewellery selected or sourced at a later stage.
The program is not presently available for customer contributions.
Submitting an expression of interest or enquiry does not create a prepaid-credit account, purchase jewellery or reserve a particular item.
No customer payment should be made or accepted as a Bespoke Program contribution until SEDA ROSE formally opens the program following the necessary legal, regulatory, operational and payment-provider review.
The proposed program is not represented as a bank account, investment product or interest-bearing savings account.
Any future launch will be governed by a separate, complete Bespoke Program Agreement supplied before enrolment or payment.
The terms of that agreement, including contributions, balance limits, redemption, cancellation, refunds, gift-card conversion and program closure, must be legally reviewed before implementation.
No provision of these website Terms independently authorises SEDA ROSE to operate a regulated payment facility or accept prepaid-credit funds.
21. Digital E-Gift Cards
Current Status: Subject to Launch Confirmation
SEDA ROSE may introduce digital e-gift cards for eligible jewellery purchases.
E-gift cards will not be offered for sale until their operational, payment-processing and legal requirements have been confirmed.
When introduced, gift cards will be subject to clearly disclosed conditions covering issue, redemption, remaining balances, expiry and applicable restrictions.
Gift cards will comply with mandatory Australian gift-card requirements, including minimum validity periods and restrictions on fees where applicable, and any other mandatory laws relevant to their sale.
No gift-card term will exclude rights that cannot lawfully be excluded.
22. Infinite Loyalty Circle
The SEDA ROSE Infinite Loyalty Circle is a separate promotional program, where offered.
Participation, qualifying purchases, reward eligibility, exclusions and redemption conditions are governed by the applicable published program rules.
A contribution towards proposed prepaid store credit is not itself a completed jewellery purchase for loyalty purposes.
Any reward offered must be honoured in accordance with its applicable terms and the law.
SEDA ROSE may change or discontinue future promotional offers where legally permitted, without unlawfully removing rewards or rights already earned.
23. Intellectual Property and Website Content
Unless otherwise indicated, the SEDA ROSE name, original branding, website text, images, graphics and other original content are owned by SEDA ROSE or used with permission.
Customers and website visitors must not reproduce or commercially exploit protected material without authorisation, except as permitted by law.
Third-party trademarks, brand names, designs and other intellectual property remain the property of their respective owners.
SEDA ROSE reserves its lawful rights in its original business materials, designs and branding.
24. Privacy and Personal Information
SEDA ROSE collects and handles customer information for legitimate business purposes, including enquiries, quotations, order processing, payment verification, customer support, fraud prevention and delivery.
Information may be disclosed to relevant suppliers, payment processors, delivery providers and professional advisers where reasonably necessary and lawful.
Our Privacy Policy explains our applicable personal-information practices in greater detail.
We will comply with privacy and data-protection obligations that apply to our operations.
Marketing communications will be sent in accordance with applicable consent, identification and unsubscribe requirements.
25. Limitation of Liability
To the maximum extent permitted by applicable law, SEDA ROSE excludes liability for losses arising solely from matters outside its legal responsibility.
Where legally permissible and enforceable, SEDA ROSE may limit liability for certain indirect or consequential losses not otherwise recoverable under applicable law.
We are not responsible for losses caused solely by inaccurate information supplied by a customer, to the extent that the loss is not attributable to a breach of our own legal obligations.
We do not guarantee future gemstone prices, market values, appreciation, investment returns or resale values.
Nothing in this section excludes or limits liability where doing so would be unlawful, including liability arising under mandatory consumer guarantees or other non-excludable rights.
Any limitation must be interpreted consistently with applicable unfair-contract-term and consumer-protection laws.
26. Circumstances Beyond Our Reasonable Control
SEDA ROSE may experience delays or interruptions arising from events beyond its reasonable control, including natural disasters, major transport disruptions, supplier interruptions, government restrictions and similar circumstances.
We will take reasonable steps required by law to address affected orders.
Such events do not automatically cancel a customer's statutory rights or relieve SEDA ROSE of obligations that remain legally enforceable.
Where an accepted order cannot be fulfilled, the applicable contractual and statutory remedies will apply.
27. Complaints and Dispute Resolution
Customers are encouraged to contact SEDA ROSE directly regarding concerns about products, orders, services or payments.
We may request reasonable supporting information to investigate the matter.
SEDA ROSE will assess complaints in accordance with applicable law and the relevant purchase agreement.
We aim to resolve genuine concerns fairly and professionally.
Customers remain free to exercise their legal rights, including seeking assistance from consumer protection authorities, courts, tribunals and lawful payment dispute mechanisms.
Nothing in these Terms prevents a customer from making a legitimate complaint or exercising a statutory remedy.
28. Changes to These Terms
SEDA ROSE may update these Terms to reflect changes in its services, business operations or legal obligations.
Updated terms will be published with a revised effective date.
Changes will not retrospectively remove existing contractual or statutory rights.
Material changes affecting existing customer agreements will be handled in accordance with applicable notice, consent and consumer-law requirements.
29. Governing Law
These Terms are governed by the laws applicable to SEDA ROSE's Australian business operations, including applicable Commonwealth law and, where legally appropriate, Northern Territory law.
The governing law of an individual transaction may be subject to mandatory jurisdictional and consumer-protection requirements.
Nothing in these Terms prevents customers from exercising rights under laws that apply to them and cannot lawfully be excluded.
30. Customer Identity Verification, Fraud Prevention & Transaction Security
SEDA ROSE Jewellers is committed to maintaining a secure, trustworthy and responsible purchasing environment for all customers.
To protect our customers, our business and the integrity of our services, SEDA ROSE Jewellers reserves the right to request reasonable identity verification and supporting information where necessary for fraud prevention, account security, payment verification, transaction integrity, compliance with applicable laws or the protection of legitimate business interests.
Identity verification may be required before accepting or fulfilling certain orders, establishing or accessing a Bespoke Program account, processing significant or unusual transactions, approving refunds or account changes, or releasing jewellery or other valuable goods.
Verification requirements will be proportionate to the circumstances and may include confirmation of a customer's legal name, contact details, billing information, payment authority or identity through an appropriate verification process.
Where reasonably necessary, SEDA ROSE Jewellers may temporarily delay the processing or fulfilment of a transaction while verification or security concerns are assessed.
SEDA ROSE Jewellers may decline a proposed transaction, suspend account access or take other reasonable protective action where identity cannot be satisfactorily verified, suspected fraudulent activity is identified, or proceeding would be unlawful or expose the business or its customers to material security risks.
Any cancellation, refund, retained payment or other financial consequence will be determined in accordance with the applicable agreement, Australian Consumer Law and other relevant legal obligations.
Personal information collected for verification purposes will be handled in accordance with our Privacy Policy and applicable privacy and data-protection requirements.
Nothing in this section excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under Australian Consumer Law.
